Under the New York State Labor Law, a construction worker may recover against the worksite’s owner and general contractor if the injury was caused by defective safety equipment or if “proper protection” was not made available to the worker to provide for his or her safety. This law, therefore, enables a worker to sue for damages beyond Workers Compensation for injuries caused by worksite deficiencies including defective scaffolding, improperly secured ladder, debris littered stairways, or if the employer fails to provide safety gear such as a hard hat, respirator or safety belt.
